Simone Voltolini (outsoft) has pointed me to the discussion on this forum
which includes numerous false accusations against me, and I see that you
are breaching copyright by continuing to host numerous programs on
http://retrowiki.es/badaman/index.html which are clearly subject to
copyright.
I am amazed that you have no respect at all for copyright holders, and have
not even bothered to contact the copyright holders for permission to host
these programs.
The majority of programs include copyright statements which are clear in
the boot file, the loading screens, manual and the program code (when
viewed in an ASCII viewer). It is therefore wrong to try and publish the
games without explicit permission to do so from the copyright holders as
there is no question as to who wrote / published the software.
The following titles at least are listed in direct breach of copyright and
if you have seen the previous discussions on speccy.org, you know that I,
Tom Dolezal (of Talent) and Jochen Merz all wrote and demanded that our
programs be removed from that site - only to be bombarded by people
bringing our characters into dispute.
I am disappointed that you have made no attempt at all to contact me or the
other copyright holders - why have you not done this? Unlike you, I have
spent many hours tracking down and trying to contact copyright holders and
been successful in contacting many.
It is interesting (for example) that you have uploaded QL PC Conqueror, but
not the MS-DOS disk needed to run the program - presumably because you know
that Microsoft are more likely to bring court action against you.
Text87 Plus 4 - the author of this has stated that this will NEVER be made
freeware despite my best efforts.
QLPaint (Talent)
PCB 1, PCB 2, Basic Ally (Talent)
ICE, Karate, 3D Slime, Spook, 3D Land (Eidersoft) - The copyright holder
(current company who were Eidersoft) have again refused to make this
freeware despite my best efforts
Qliberator (Liberation Software) - Again the author has refused to make
this freeware despite my best efforts
Brainsmasher, Diamonds, Full House, Crazy Cards (Jochen Merz Software)
QLFlight, Alien Hijack, The Lost Pharoah, Strip Poker, Hopper, Jungle Eddi,
Quazimodo, Cuthbert, Crazy Painter, Cosmos, Night Nurse, West and Lost
Kingdom of Zkul, Aquanaut 471, Horrorday (Talent)
Flightdeck (SPAM! Software and B. Denchfield)
Vroom, Wanderer (Pyramide)
QL Jabber, Meteor Storm (Arrakis)
D-DAY (Games Workshop)
QL Hyperdrive - again the author has expressly denied his permission for
this game to be re-released
Metacomco Compilers are problematic as they are based on licences from
Borland mainly - the people who ran Metacomco are on Facebook, but are
unwilling to discuss this - presumably because of the licensing issue.
Please note that Tridim (Pyramide) is now freeware thanks to permission
from Pyramide
As you are aware, I have the marketing rights to software by Jochen Merz
Software, Talent, SPAM! Software, Arrakis and Pyramide titles.
Please therefore remove these with immediate effect and confirm the number
of illegal downloads of these programs.
SPAM!
SPAM! Software
Como no tenía suficiente:
There are some further programs on there which have been missed and are
copyright :
DEATH (This is DeathStrike by Talent and so I have the distribution rights)
HAVOC (This is Lands of Havoc by Microdeal / Talent and so I have the
distribution rights)
Droidzone (This is by Paul Tuck - again I have the distribution rights)

I understand you are offering my work on your website at
http://retrowiki.es/badaman/QL/utilidades.html
You have no right to do this. Speedscreen is my copyright property and is
clearly marked as such and remains available from me.
Please remove it immediately and acknowledge that you have done so.

pero Oh Wait ! , seguimos recibiendo correos.
Dear Sirs,
I am disappointed that the discussion on your site is continuing to bring
my name into disrepute - I have a long history of supporting the QL and its
users but unfortunately, you have refused to allow me access to your site
to refute and correct the various allegations.
Those who have any interest might like to read the following:
http://www.qlforum.co.uk/viewtopic.php? ... 150#p13485
This highlights what has been achieved so far by my personal preservation
project, despite what your members seem to think.
There also seems to be some confusion over my software - suggestions that I
take copyright software and continue to sell it even though I do not have
the rights.
a) Cash Trader and QL Payroll by Chas Dillon - in effect I only charge for
the changes I made to these programs and ongoing support. Chas Dillon was
supportive of this at the time, as he had no interest in continuing work on
the programs and he decided to make his sources publically available.
b) The software on http://SPAM!/updates.html
This is ALL copyright software. I offer working copies of the software to
help those who can prove that they own originals, so that they can still
access working versions in the absence of any other support method. I do
not provide these programs without proof of ownership of the original so
the charge is only for support and not a breach of copyright. If people
want to offer a similar service free of charge, then they can of course do
so, but must insist on seeing proof of ownership.
I would suggest that if people want clarification over issues then they
have the courtesy to contact me directly via my website rather than posting
upsetting comments on your forum, in the hope that I will read and respond
(I guess they do not know that I have been told I am not welcome on your
forums and so cannot respond).
Maybe they would prefer I withdrew as a retro trader completely and stopped
providing the type of support for QL users I have been known for for the
past 30 years.
It is a shame that your members feel free to slander me and try to ruin my
reputation. As a direct result, you will see that I have already stated
that I intend doing no more with my own preservation project for now and
will not be trying to track down any other copyright holders and ask them
to release the software as freeware. This has the result that the masses
of QL software in my possession (much of which is still to be sorted
through) will remain in my possession and unavailable to QL users.
As people will find from the spreadsheet linked to on the QL Forum, there
is a mass of freeware which is either missing in action, or corrupt. All
of which it would be better for the community to work together to track
down and get working rather than moaning about software which is still
available to purchase.
quietos, que todavía falta lo mejor por venir...

¿ Vaya, y esto ? , ¿ acaso no contabas con ello ?
Dear sirs,
What exactly are you looking for?
I can ask for Tom Dolezal (Talent) and other copyright holders to email you directly, otherwise, the copyright statements are generally clear in the loading screens, boot screens, manuals and program code if you bothered looking.
There is no certificate of ownership as that is not required to establish copyright status. Copyright protection exists as soon as a program / book etc is written. It is up to publishers to prove that they have the rights to publish the item.

SPAM! Software
No se hace tardar no ....
Sir
It has been brought to my attention by SPAM! software, that you are illegally distributing through your website the following programs for the QL computer:
QLFlight, Alien Hijack, The Lost Pharoah, Strip Poker, Hopper, Jungle Eddi, Quazimodo, Cuthbert, Crazy Painter, Cosmos, Night Nurse, West and Lost Kingdom of Zkul, Aquanaut 471, Horrorday.
These programs are the copyright of my company, Talent+ since 1992. You have no licence or consent from myself or my company, Talent+, the copyright holder to supply or distribute this software in any format . Only SPAM! software are the authorised distributor for these QL programs.
I therefore demand:
1. that you immediately remove the above mentioned titles from your website
2. to destroy all copies of the above mentioned programs and provide written confirmation of this.
3. to provide full details regarding the copies of each of these programs you have illegally distributed in breach of my copyright.
I trust that you will co-operate fully in resolving this copyright infringement as it is covered by international copyright law.

Good. Thank you.
Please obtain permission before posting any of my work online again. It is not abandonware, whatever that may mean, and you will note that I have been generous with my work, e.g. Turbo, when further development was facilitated by sharing all the original source and documentation, and releasing my DIY Toolkit with source and bonus materials as Cardware, I have also made a custom version of SPEEDSCREEN for registered users of the emulator QL2K. This does not mean that anyone can copy my work and it is certainly not in the public domain unless I have explicitly said so.

There is no legal registration of copyright or requirement for it in the UK. You can see that my name Simon N Goodwin is prominent in the software and manual. I was and am the owner of the publisher Creative CodeWorks as is widely documented online (e.g. at http://www.SPAM!.com/ql_wiki/i ... peedscreen) and my development of the software is described on my website at http://simon.mooli.org.uk/AF/article/commercial.html#QL

Were still waiting. Please Kindly send us any documentation or certificate of ownership of the software and its legal registration.
